Terms of Business
Our hours of business are 9am until 5.30pm Monday to Friday.
The placing of an order forms a contract between David Farnell Photographic Laboratory Ltd (“the Laboratory”) and the Customer and the following terms and conditions apply.
All orders shall be in writing and signed by the Customer. If an order is accepted orally by a regular customer, and this is entirely at the Laboratory’s discretion, then these terms and conditions shall still apply and the Laboratory accept no liability for any error that may occur in the carrying out of that order.
Should an order be cancelled then the Laboratory reserves the right to charge a percentage of the total invoice value for work already carried out.
The Laboratory will take all precautions to protect the Customer’s materials, however we only accept orders on the basis that their value does not exceed the retail price of the equivalent new unexposed material. Liability from loss or damage is limited to the replacement of the material itself. Where material is deemed to be of extreme high value this fact must be declared to us in writing prior to the work being undertaken and where the replacement value of the raw material is exceeded by this maximum value the Customer must consider the possibility of effecting insurance cover. The Laboratory is not liable for any losses arising from delay in completing an order – times and dates given for completion of orders are as a guide only.
It is the responsibility of the Customer to ensure that there will be no breach of copyright and it is understood that any work received by the Laboratory is on the specific understanding that under 1988 Copyright and Patents Act the Customer undertakes that he has obtained the copyright release or license for material submitted and will indemnify the Laboratory against any breach of the law. The Customer assumes liability for any resulting violation of copyright in any action brought by a third party. The Laboratory reserves the right to refuse any order for whatever reason, particularly if it suspects a breach of copyright, obscenity or libel laws.
The Customer shall indemnify the Laboratory against any action by a third party relating to damages, loss or any other claim whatsoever, arising out of the order when the Laboratory has followed the instructions of the Customer.
The sizes of prints are approximate and may occasionally be very slightly under or over sizes quoted.
Every effort will be made to achieve as close a match as possible however, the Customer must accept that colour matching will be deemed correct at our discretion. If, however, accurate colour matching is absolutely essential then the Customer must supply colour guides with the order, although it is still impossible to guarantee an exact match due to the limitations of colour processes.
This price list will come into effect from 2009 and will supersede any previous price lists. However, we reserve the right to alter the prices any time without notice. All prices listed are exclusive of VAT which will be added to all charges at the current rate.
Please note that if the order is urgent we will operate an express service by prior arrangement and we reserve the right to charge a further 100% of the invoice value if required within 8 working hours and a further 50% if required within 12 working hours.
Orders under £10.00 may be subject to a handling charge of £1.00.
Postage & packaging minimum charge £3.00.
Payment terms are cash with order unless an account has been arranged with the Laboratory in which case payment is required within 30 days of the date of invoice. The account will be reviewed regularly by the Laboratory and may be discontinued at any time entirely at the Laboratory’s discretion according to the manner in which the account is conducted. The Laboratory reserves the right to charge interest on all overdue accounts. The Laboratory has a general lien on all the Customer’s material in its possession and reserves the right to retain these materials until all monies due have been received.
The Laboratory reserves the right to dispose of any of the Customer’s material which are not collected within 4 months from the date of the invoice (unless prior arrangements have been made) and cannot accept any liability for any loss incurred.
Entirely at the Laboratory’s discretion, those customers who regularly pay their invoices within 30 days and use the Laboratory frequently may be able to obtain a 5% discount on application. This benefit will only apply whilst the account remains up to date i.e. all invoices are paid within 30 days.
Should there be any cause for complaint then it is imperative that the Laboratory is notified within 5 working days of receipt of the goods.
The Laboratory will always make every possible effort to fulfil orders but this must be subject to variation or cancellation in the event of an act of God, strikes, fire or any other causes beyond the control of the Laboratory.
